Please read these terms and conditions carefully before placing an order or commissioning work. By using this website and purchasing from us, you agree to be bound by these terms.
1. About us
This website is operated by Cailleach, a sole trader selling original artwork, art prints, and digital downloads at cailleach-artist.com. References to “we”, “us”, and “our” refer to Cailleach.

2. Placing an order
By placing an order on this website you confirm that you are at least 18 years old and that the information you provide is accurate and complete.
Your order constitutes an offer to purchase. We reserve the right to decline or cancel any order at our discretion, for example if a product is out of stock, if there is a pricing error, or if we are unable to verify payment. If we cancel your order after payment has been taken, we will issue a full refund promptly.
A contract between you and us is formed when we send your order confirmation email.
3. Prices and payment
All prices are shown in GBP (British pounds sterling) and are inclusive of any applicable VAT where stated. We reserve the right to change prices at any time. The price you pay is the price shown at the time you place your order.
Payment is taken at the time of order. We accept card payments via Stripe. All card transactions are processed securely by Stripe and we do not store your card details.
4. Digital downloads
Digital download files are delivered by email link upon confirmed payment. Files are served directly from our website.
By purchasing a digital download and clicking to begin your download, you expressly consent to the immediate supply of the digital content and acknowledge that you lose your right to cancel under the Consumer Contracts Regulations 2013 once the download has begun.
If you experience a technical issue with your download, please contact us at hello@cailleach-artist.com within 14 days of purchase and we will do our best to resolve it promptly.
Digital files are for personal, non-commercial use only. You may not resell, redistribute, share, or use the files for commercial purposes without our express written permission.
5. Physical prints
Physical prints are produced and fulfilled by our third-party print-on-demand partner. Estimated delivery times are provided at checkout and are given in good faith but are not guaranteed. We are not liable for delays caused by our fulfilment partner or by postal and courier services.
Prints are produced to order. Please check your order details carefully before confirming purchase as we are unable to amend orders once they have been submitted to our fulfilment partner.
6. Commissions
Commission slots are offered at our sole discretion and are limited in number. Joining a notification list or making an enquiry does not guarantee a commission slot.
Once a commission is agreed and a deposit or full payment is made, a bespoke contract is formed for the creation of a custom artwork. Under the Consumer Contracts Regulations 2013, the standard 14-day right to cancel does not apply to bespoke commissions once work has begun.
Commissions are produced in Cailleach’s own artistic style. We will work from your reference images and written brief but the final piece is an original work of art and its exact appearance cannot be guaranteed in advance. We will share work-in-progress previews at agreed stages so you can provide feedback before the work is finalised.
Commission timescales are estimates only. We do not work to hard deadlines. If you need a piece by a specific date, please raise this before commissioning and we will advise honestly on whether it is achievable.
Payment terms for commissions will be confirmed at the time of booking. Deposits are non-refundable once work has begun except where we are unable to complete the commission.
7. Returns, refunds, and cancellations
Digital downloads
Digital downloads are non-refundable once the download has begun. This is in accordance with Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, which provides that the right to cancel does not apply to digital content where supply has begun with your prior express consent and acknowledgement that your cancellation right is lost.
If your download file is corrupt, incomplete, or technically defective, please contact us within 14 days of purchase at hello@cailleach-artist.com and we will provide a replacement file or a full refund at our discretion.
Physical prints
As prints are produced to order, we are unable to accept returns or cancellations for change of mind once an order has been submitted to our fulfilment partner.
If your print arrives damaged, defective, or materially different from what was ordered, please contact us within 14 days of delivery with a photograph of the item and your order number. We will arrange a replacement or refund in accordance with your rights under the Consumer Rights Act 2015.
If your order is lost in transit, please contact us and we will investigate with our fulfilment partner and arrange a resolution.
Commissions
Commissions cannot be cancelled or refunded on the basis of artistic style or personal preference once work has begun, as they are bespoke works created specifically for you.
If the completed work materially differs from the agreed written brief, please contact us and we will work with you in good faith to reach a fair resolution, which may include revisions or a partial refund at our discretion.
Your statutory rights under the Consumer Rights Act 2015 are not affected by the above.
8. Intellectual property
All artwork, images, and content on this website are the intellectual property of Cailleach and are protected by UK copyright law. Purchasing a product does not transfer copyright or any other intellectual property rights to you.
Print and digital download purchases grant you a personal, non-exclusive, non-transferable licence to display and enjoy the work for personal non-commercial use only.
You may not reproduce, copy, resell, redistribute, or use any artwork commercially without our prior written consent. Unauthorised commercial use of our artwork will be treated as copyright infringement.
9. Colour accuracy
We make every effort to represent our artwork accurately on this website. However, colours displayed on screen may vary from the finished printed product due to differences in screen calibration, display settings, and the print process itself. Slight colour variation between screen and print is not considered a defect.
If colour accuracy is important to you, please contact us before placing your order.
10. Limitation of liability
To the fullest extent permitted by applicable law, our total liability to you in connection with any order shall not exceed the price paid for the goods or services in question.
We are not liable for any indirect, incidental, or consequential loss arising from your use of this website or our products, including but not limited to loss of data or loss of profits.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
11. Your statutory rights
Nothing in these terms and conditions affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
12. Governing law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these terms
We reserve the right to update these terms and conditions at any time. The “Last updated” date at the top of this page will reflect any changes. Your continued use of this website after changes are posted constitutes acceptance of the updated terms.
